Explained to person in charge (PIC) that all handwashing sinks must be accessible at time of operation to ensure adequate handwashing is taking place. PIC removed items at time of inspection.

PIC confirmed that the shrimp is raw and marinated in lime only. Explained to PIC that If from a supplier, a written agreement or statement from the supplier stipulating that the fish are frozen to a temperature for specified time must be retained on site of the operation. PIC states they purchase the shrimp from a local retail store in the area but do not have any written agreement from the supplier. Explained to PIC that unless they perform the parasite destruction themselves in the facility and have records indicating the process, then a written statement must be provided from the supplier. PIC voluntarily discarded the ceviche at time of inspection. PIC will work on obtaining shrimp used for raw, lime marinated ceviche from an approved supplier and will not sell the product until it is achieved. PIC has the option to fully cook the shrimp to the adequate temperature as well for the ceviche if raw, lime-marinated ceviche is no longer wanted.

PIC states the TCS foods were cooked an hour and a half before inspection. Explained to PIC that all hot food must be maintained at 135*F or above. PIC was able to reheat items at time of inspection. Also discussed used time as a control for the food items listed above and provided PIC with time as a control sample at time of inspection.

PIC was able to confirm those dates were accurate. Explained to PIC that A food shall be discarded if: It exceeds the 7 days at 41?F, except time it is frozen or is in a container or package that does not bear a date/day and has been held for > 24 hours and facility has no date marking system in place. PIC discarded of the items listed above at time of inspection.

PIC states the items were made 2 days ago and they do not regularly label the items listed with the date they were made. Explained to PIC that TCS food must be clearly marked to indicate the date or day the food shall be consumed on premises, sold, or discarded when held at a temperature of 41°F or less for a maximum of 7 days. The day of preparation shall be counted as Day 1. PIC was able to provide dates on the items at time of inspection.

Explained to PIC that their menu must have disclosure by either describing the product as being raw or undercooked (i.e. raw oysters, burgers cooked to order) or by utilizing an asterisk directing them to a footnote that describes the item as being served raw or undercooked.
• Must have a reminder that directs the consumer to ask for additional information or has one of the 2 approved statements in the code.

Core-2-102.12(A), C: Certified Food Protection Manager>>>At time of inspection none of the present staff were able to provide documentation verifying that they are a Certified Food Protection Managers. Maricopa County requires all establishments that serve open food, which requires time/temperature control for food safety, to have at least one (1) Certified Food Protection Manager (CFPM) on staff. According to the updated Maricopa County Environmental Health Code Paragraphs 2-102.12(A) and 2-102.20(B) state that the Person in Charge shall be the Certified Food Protection Manager. Per paragraph 2-101.11, a Person in Charge must be present during all hours of operation. The Person in Charge shall be a Certified Food Protection Manager and is required to be onsite during the hours of operation. Correct by next routine inspection. ***2nd Consecutive violation***

"A" for Food Safety
Through our grading system, Maricopa County Environmental Services Department provides at-a-glance indications of how food establishments perform during food safety inspections. This system is designed to grade food establishments in terms of food safety requirements and provide recognition to those who choose to participate.
How does it work?
The issuance of grade cards to food establishments is based on voluntary participation. The person in charge, who is present during the inspection, will be asked whether they would like to participate in the Grading System. This will be decided prior to each inspection. If an establishment does not participate in the Grading System, Not Participating or NP will appear on the inspection report, and the inspection will still occur. If an establishment does participate, a grade of A, B, C, or D will be determined at the conclusion of the inspection using the Grading System chart below. Participating establishments will then be provided with a grade card that can be posted in the establishment. The status of the establishment’s grade will also appear on the Restaurant Ratings page of the department’s website.
How can I determine the grade?
The Grading System chart can be used to determine grades earned for establishments that do not participate. Grades are determined by the number of Priority and Priority Foundation violations received at the time of inspection. Violation types are defined in general terms below.
Definitions
- Priority Violation
- Major violation that directly contributes to increasing the risk of foodborne illness or injury (e.g. Food employees do not properly wash hands when required).
- Priority Foundation Violation
- Minor violation that does not directly contribute to an increased risk of foodborne illness but failure to correct this violation may lead to the occurrence of a priority violation. For example, hand washing soap and paper towels not available at hand wash sink (may lead directly to food employees not properly washing hands when required).
- Core Violation
- Minor violation that relates to general maintenance and sanitation (e.g. No sign reminding employees to wash hands).
- Cutting Edge Program
- All county food-related establishments can partner with Maricopa County to implement a proactive approach to reducing foodborne illness risk factors by implementing food safety systems that include policies, training, and verification processes. Partners enrolled in the Cutting Edge Program receive an A+ when an A is earned.
