5-205.13 - Priority Foundation: Scheduling Inspection and Service for a Water System Device Addl Notes: Establishment is using a brass ASSE 1022 backflow preventer on the soda fountain. No backflow certificates or proof of yearly replacement could be provided at the time of inspection. Provided a stainless steel ASSE 1022 or RPZ (reduce pressure zone) assembly prior to re-inspection. Advised PIC a minor remodel will be required to add an RPZ to the water connection. Discussed ASSE 1022 Dual Check systems must be replaced year and replaced if they begin leaking. All testable backflow devices must be certified. A re-inspection will be conducted on 4/18/2025 to ensure a remodel has been applied for or the backflow has been replaced. Corrective Action: Correct prior to re-inspection.

PRIORITY VIOLATION-5-202.13 - Priority: Backflow Prevention, Air Gap

Addl Notes: Observed the soda machine drain line inserted into a plastic tub with lid without an air gap. Drain lines must be plumbed to a sanitary sewer connection and cannot empty into a bucket or other container. Advised PIC to submit for a remodel to relocate the soda machine to an area with an appropriate floor sink or floor drain or to provide a hub drain from the adjacent hand sink drain line. Advised PIC is a hub drain is used, the machine may need to be elevated so the machine is sloped to drain and a rigid drain line is installed and secured. Provide an approved air gap prior to re-inspection on 4/18/2025. Corrective Action: Correct prior to re-inspection.

Comments/Details

A re-inspection will take place on 4/18/2025 to ensure Priority and Priority foundation violations in category 51 have been corrected.
Due to the violations noted on this inspection report, County legal action may result from this inspection.
Upon inspection, a remodel has taken place which may require an application and plans to be submitted, and/or additional permits. Please submit an application, supporting documentation, and fees within 5 business days or legal action may result pursuant to MCEHC Chapter 1, Regulation 4(e). Applications with supporting documentation can be submitted via the customer portal "Permit Center" online at maricopacountyaz-energovweb.tylerhost.net/apps/selfservice#/home.
Establishment's soda fountain does not have an approved air gap and is not directly disposing of drained liquids directly to an approved sanitary sewer connection (i.e. floor sink or floor drain). Also observed a brass ASSE 1022 backflow in use where a stainless steel backflow is required. Advised establishment relocate soda machine near the 3 comp sink. A re-model is required to add the required air gap to a sewer connection and is required if adding an RPZ assembly.

Through our grading system, Maricopa County Environmental Services Department provides at-a-glance indications of how food establishments perform during food safety inspections. This system is designed to grade food establishments in terms of food safety requirements and provide recognition to those who choose to participate.

How does it work?

The issuance of grade cards to food establishments is based on voluntary participation. The person in charge, who is present during the inspection, will be asked whether they would like to participate in the Grading System. This will be decided prior to each inspection. If an establishment does not participate in the Grading System, Not Participating or NP will appear on the inspection report, and the inspection will still occur. If an establishment does participate, a grade of A, B, C, or D will be determined at the conclusion of the inspection using the Grading System chart below. Participating establishments will then be provided with a grade card that can be posted in the establishment. The status of the establishment’s grade will also appear on the Restaurant Ratings page of the department’s website.

How can I determine the grade?

The Grading System chart can be used to determine grades earned for establishments that do not participate. Grades are determined by the number of Priority and Priority Foundation violations received at the time of inspection. Violation types are defined in general terms below.

Definitions

Priority Violation
Major violation that directly contributes to increasing the risk of foodborne illness or injury (e.g. Food employees do not properly wash hands when required).
Priority Foundation Violation
Minor violation that does not directly contribute to an increased risk of foodborne illness but failure to correct this violation may lead to the occurrence of a priority violation. For example, hand washing soap and paper towels not available at hand wash sink (may lead directly to food employees not properly washing hands when required).
Core Violation
Minor violation that relates to general maintenance and sanitation (e.g. No sign reminding employees to wash hands).
Cutting Edge Program
All county food-related establishments can partner with Maricopa County to implement a proactive approach to reducing foodborne illness risk factors by implementing food safety systems that include policies, training, and verification processes. Partners enrolled in the Cutting Edge Program receive an A+ when an A is earned.
