Addl Notes: Observed containers of raw bacon stored above containers of cooked duck in the small, refrigerated prep unit under ice bath station. Also observed raw salmon stored above cooked flat iron steaks in the small, refrigerated prep unit under ice bath station. Also observed container of raw unpasteurized whole shelled eggs stored on top of canned coconut milk in the refrigerated unit in the bar. All raw animal proteins must be stored below ready-to-eat (RTE) foods and stored according to cooking temperature at all times to prevent cross contamination. PIC properly stored all raw animal proteins according to the final cooking temperature based on the cooking parameters in § 3-401.11 of the Food Code. Corrective Action: Corrected at time of inspection. REPEAT VIOLATION (4TH CONSECUTIVE)

Addl Notes: Observed whipped goat cheese (dated 1/23) and roasted garlic (dated 1/16). The person in charge verified that these dates were correct. All RTE (ready to eat)/TCS (time/temperature controlled for safety) foods past 7 days of preparation were discarded by PIC at the time of inspection. RTE/TCS foods requiring date marking must be date marked within 24 hours and sold or discarded after 7 days (including the day it was made as day 1). Corrective Action: Corrected at time of inspection.

Addl Notes: Observed salmon and Trinidadian sour with no disclosure (or symbols indicating) that these foods may be served raw or undercooked; per the PIC these foods maybe served raw or undercooked. Also, it is not disclosed anywhere that these foods or the burgers maybe served raw or undercooked. Discussed updating the reminder statement to include disclosure (for example: These foods are served raw or undercooked. Consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase your risk for foodborne illness; especially if you have a medical condition). Discussed adding symbols to salmon and Trinidadian sour. Offering and serving undercooked proteins requires an approved consumer advisory at all points of sale; and must contain an approved disclosure method and reminder statement. Must provide approved consumer advisory at all points of sale prior to re-inspection. Corrective Action: Correct prior to re-inspection on 02/10/25. REPEAT VIOLATION (2ND CONSECUTIVE)
Comments/Details
Due to the violations noted on this inspection report, County legal action may result from this inspection.
Discussed and helped develop time as a public health control policy. Establishment currently serves raw/undercooked farm raised Atlantic salmon. Establishment must acquire a statement from the supplier stating that the fish were raised in in open water, are raised in net-pens OR raised in land-based operations such as ponds or tanks AND are fed formulated feed, such as pellets, that contains no live parasites infective to the aqua cultured fish.
Of note: Observed a smoker outside of the establishment. The person in charge indicated they use it to smoke meats for the restaurant (this was not observed at time of inspection). This activity qualifies as an Outdoor Food Operations; an outdoor food operation refers to cooking, grilling, roasting, and hot/cold holding and or limited service of foods outside the fully enclosed food establishment that does not meet the definitions of a “caterer, adventure food service, mobile food type 1-III, temporary,
promotional, annual, or seasonal-food type establishment” and operates in conjunction with a fixed permitted food establishment located on the same premises that will provide “support services.”
1. The outdoor food site must be located on the “physical premises” of the fixed permitted support food establishment as defined in the Maricopa County Environmental Health Code.
2. The fixed permitted establishment must be adequately equipped and capable of cooking and serving food outside in a safe and sanitary manner.
3. Plan submittal is required for this activity. It must be permitted under an approved existing permit in the establishment.

If the establishment would like to continue smoking meats outdoors, they must apply for a remodel permit with Maricopa County Environmental Services.
Definitions

- Minor violation that does not directly contribute to an increased risk of foodborne illness but failure to correct this violation may lead to the occurrence of a priority violation.
