Addl Notes: At expo station, employee provided ready to eat toppings on customer food with bare hands. At bar, observed employees handling ready to eat garnishes for customer drinks with bare hands. Educated employees on using tongs, picks, or washed gloved hands to handle ready to eat foods. Discussed the importance of preventing bare hand contact with ready-to-eat (RTE) foods with the person-in-charge (PIC). Bare hand contact is not approved with ready-to-eat (RTE) food items. Corrective Action: Corrected at time of inspection.

Addl Notes: Throughout kitchen, manager states TCS foods (cooked potatoes, cooked sauces) using time as a public health control. At start of inspection, no start/discard times noted on food items. Employees provided start/discard times to TCS foods using time as a public health control. Establishment does not have a written time as a public health control procedures. Provide written procedures within 10 days. Time as a Public Health Control requires written procedures detailing process for Time as a Public Health Control and time-stamping for items actively held under Time as a Public Health Control. Addl Notes: On menu, establishment offers fish and tartare undercooked, without a consumer advisory statement on menu. Provide asterisked statement stating "*These items may be served raw or undercooked. Consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of a food borne illness". Provide updated menu showing consumer advisory within 10 days. Offering and serving undercooked proteins requires an approved consumer advisory at all points of sale; and is to contain an approved disclosure method and reminder statement. 3-502.11 - Priority Foundation: Variance Requirement. Addl Notes: In walk in cooler and in cold holding units on cook line, reduced oxygen packaged raw and cooked meats without a variance. On cook line, reduced oxygen packaged meats in sous vide bath without a variance. Sous vide bath was removed and all reduced oxygen packaged foods were removed from packaging. In walk in cooler, establishment reduced oxygen packaged thawed fish. Also observed cooked octopus and thawed lobster stored in establishment reduced oxygen packaging. All fish was removed from packaging. Via email, provided information on obtaining a variance for reduced oxygen packaging and sous vide. Discontinue all reduced oxygen packaging and sous vide until variance is obtained. A FOOD ESTABLISHMENT shall obtain a VARIANCE from the REGULATORY AUTHORITY as specified in § 8-103.10 and under § 8-103.11 before: (D) Packaging TIME/TEMPERATURE CONTROL FOR SAFETY FOOD using a REDUCED OXYGEN PACKAGING method except where the growth of and toxin formation by Clostridium botulinum and the growth of Listeria monocytogenes are controlled as specified under § 3-502.12. A variance/HACCP must be obtained prior to conducting any specialized processes. Variance/HACCP applications are available through the customer portal "Permit Center" at https://maricopacountyaz-energovweb.tylerhost.net/apps/selfservice#/home. Reviewed with employees: storing of in use utensils, obtaining fish from permitted fish purveyors, excluding employees working with food, including at bar, if unable to properly wash hands. Also reviewed parasite destruction - ensure parasite destruction documentation is maintained for any required fish that is offered raw or undercooked.
Establishment does not have, and does not want to obtain, a dog friendly patio permit. Remove dog friendly patio signage from gates.
Ensure all employees working with food obtain food worker certification from ANSI certified online site.
"A" for Food Safety
Through our grading system, Maricopa County Environmental Services Department provides at-a-glance indications of how food establishments perform during food safety inspections. This system is designed to grade food establishments in terms of food safety requirements and provide recognition to those who choose to participate.
How does it work?
The issuance of grade cards to food establishments is based on voluntary participation. The person in charge, who is present during the inspection, will be asked whether they would like to participate in the Grading System. This will be decided prior to each inspection. If an establishment does not participate in the Grading System, Not Participating or NP will appear on the inspection report, and the inspection will still occur. If an establishment does participate, a grade of A, B, C, or D will be determined at the conclusion of the inspection using the Grading System chart below. Participating establishments will then be provided with a grade card that can be posted in the establishment. The status of the establishment’s grade will also appear on the Restaurant Ratings page of the department’s website.
How can I determine the grade?
The Grading System chart can be used to determine grades earned for establishments that do not participate. Grades are determined by the number of Priority and Priority Foundation violations received at the time of inspection. Violation types are defined in general terms below.
Definitions
- Priority Violation
- Major violation that directly contributes to increasing the risk of foodborne illness or injury (e.g. Food employees do not properly wash hands when required).
- Priority Foundation Violation
- Minor violation that does not directly contribute to an increased risk of foodborne illness but failure to correct this violation may lead to the occurrence of a priority violation. For example, hand washing soap and paper towels not available at hand wash sink (may lead directly to food employees not properly washing hands when required).
- Core Violation
- Minor violation that relates to general maintenance and sanitation (e.g. No sign reminding employees to wash hands).
- Cutting Edge Program
- All county food-related establishments can partner with Maricopa County to implement a proactive approach to reducing foodborne illness risk factors by implementing food safety systems that include policies, training, and verification processes. Partners enrolled in the Cutting Edge Program receive an A+ when an A is earned.
